Motor Vehicle Accident Claims

What is a motor vehicle accident claim?

Every day on our Queensland roads, many people, unfortunately, become victims of motor vehicle accidents, causing minor and serious injuries or even death. Motor vehicle accidents can range anywhere from being a pedestrian, cyclist, driver or passenger of a motor vehicle, motorbike, scooter, Taxi, Uber or bus.

What can be claimed?

If you have been injured in a motor vehicle accident, its likely you will incur out-of-pocket medical expenses for surgeries, rehabilitation, medications, travel and, in some instances, loss of income due to not being able to work.

There are also some instances where a motor vehicle accident can cause death and, in those circumstances, both the children and spouse of a deceased who have suffered a psychological injury due to the death of a loved one, can also make a claim for compensation for that injury. Other types of compensation claims where death is caused, can include loss of income due to not being able to work, claims for dependency and funeral reimbursement costs.

Who pays for an injured person’s compensation?

Compensation paid to an injured person in a motor vehicle accident, is paid through the ‘at-fault’ drivers Compulsory Third Party Insurer, also commonly known as CTP Insurance. CTP Insurance is automatically paid when a motor vehicle is registered.

What if the motor vehicle is unregistered?

If you are injured in a motor vehicle accident by an unregistered vehicle, there are still options to claim compensation. However, stringent time limits apply to be eligible to make a claim, and these time limits are much stricter than other time limits that apply to general motor vehicle claims. It’s essential to obtain legal advice immediately after an accident involving an unregistered motor vehicle.
