Public Liability Accident Claims

What is a public liability claim?

Public liability claims are when people sustain injury on a third-party premises, property, or site. For example, this might include injuries sustained at a shopping centre, petrol station, theme park, sporting events, resort, hotel, private property, rental properties, public parks, or halls, at events such as concerts, pubs or even as a contractor working on a job site for a property developer.

Proving fault on the at-fault party

To be able to seek compensation for a public liability claim, you must be able to prove fault on the owner or property occupier or manager of the third-party site where you were injured. In other words, you must be able to prove your injuries were caused due to the fault and negligence of the third-party and that such injury was reasonably foreseeable.

 What can be claimed?

If you have been injured on a third-party premises, its likely you will incur out-of-pocket medical expenses for surgeries, rehabilitation, medications, travel and, in some instances, loss of income due to not being able to work.

If you have sustained an injury on a third-party site, it’s essential to obtain legal advice about your rights.
